PART A: TERMS OF SERVICE

1. Introduction & Acceptance

These Terms of Service ("Terms") govern your use of the TechTree platform ("Platform") operated by C2C Talent Network LTD, trading as TechTree ("TechTree", "we", "us", "our"). By applying to jobs, sharing your information, or otherwise using the Platform, you accept these Terms and our Privacy Policy (Part B below).

2. Service Description

TechTree is an AI-powered job matching platform that:

• Analyzes your professional information (CV, profile, preferences) to identify relevant job opportunities
• Matches you with jobs from TechTree clients and displays aggregated job listings from external sources
• Facilitates introductions between candidates and employers for TechTree client roles
• Provides AI-driven recommendations and career insights
• Enables communication between candidates and employers regarding recruitment opportunities
• Requests referrals from candidates for roles that match their professional network

Important: External job listings displayed on TechTree are for informational purposes. Applications to external jobs must be submitted directly on the original job board or employer website. TechTree does not process applications for external listings.

3. Eligibility

You must be at least 16 years old to use the Platform. By using TechTree, you confirm you meet this age requirement.

4. How TechTree Works

4.1 For Candidates

When you use TechTree:

1. You share information - You provide your CV, contact details, work preferences, and other professional information
2. Our AI analyzes your profile - We use AI to understand your skills, experience, and job preferences
3. We match you with opportunities - Our system identifies relevant jobs from our clients and displays external job listings
4. We facilitate introductions - For TechTree client roles, we share your profile with employers whose jobs match your preferences
5. We communicate with you - We notify you about job matches, recruitment updates, platform features, events, and request feedback
6. We may request referrals - We may ask you to recommend people from your network for specific roles

4.2 How We're Remunerated

TechTree operates similarly to a recruitment agency. We are compensated by our employer clients when we successfully help them find candidates who are hired for their open roles. We do not charge candidates for our services.

4.3 No Guarantee of Employment

TechTree facilitates connections between candidates and employers but does not guarantee job offers, interviews, or employment outcomes. Hiring decisions are made solely by employers.

5. User Obligations

You agree to:

• Provide accurate, current, and complete information
• Update your information promptly if it changes
• Respond professionally to employer communications
• Use the Platform only for legitimate job-seeking purposes
• Comply with all applicable laws and regulations
• Not misrepresent your qualifications, experience, or identity
• Maintain the confidentiality of any proprietary information shared by employers

You may not:

• Use the Platform for any unlawful purpose or to violate any laws
• Impersonate another person or entity
• Upload malicious code, viruses, or harmful content
• Scrape, harvest, or collect user data from the Platform
• Interfere with or disrupt the Platform's operation
• Use automated systems (bots, scrapers) to access the Platform without authorization
• Submit false, misleading, or fraudulent information
• Harass, abuse, or harm other users or TechTree personnel
• Attempt to gain unauthorized access to TechTree systems
• Use the Platform to spam, solicit, or promote third-party services
• Upload content that infringes intellectual property rights
• Create multiple accounts to circumvent Platform rules

7. Intellectual Property

7.1 Your Content

You retain all ownership rights to content you upload (CVs, cover letters, documents). By uploading content, you grant TechTree a worldwide, non-exclusive, royalty-free license to use, store, process, and share your content solely to provide our services and facilitate introductions to employers.

7.2 TechTree Content

The Platform, including its design, features, algorithms, and content (excluding user-uploaded content), is owned by TechTree and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. Account Termination & Suspension

8.1 By You

You may stop using the Platform at any time by emailing data@techtree.dev to request deletion of your data.

8.2 By TechTree

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Providing false or misleading information
• Behavior that harms TechTree, other users, or employers
• Any reason we deem necessary to protect the Platform's integrity

Upon termination, your right to use the Platform ceases immediately.

9. Disclaimers

The platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

TechTree does not warrant that:

• The Platform will be uninterrupted, secure, or error-free
• AI matching results will be accurate or lead to employment
• Job listings are current, accurate, or still available
• Employer information is accurate or reliable

10. Limitation of Liability

To the maximum extent permitted by law, TechTree shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of the Platform.

Our total liability to you for any claims arising from these Terms or the Platform shall not exceed £100 GBP.

11. Indemnification

You agree to indemnify and hold TechTree, its affiliates, officers, directors, employees, and agents harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Content you upload or submit

12. Modification of Terms

We may update these Terms periodically. Material changes will be communicated via email or updated Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

PART B: PRIVACY POLICY

1. Introduction

C2C Talent Network LTD, trading as TechTree, respects your privacy and is committed to protecting your personal data. This Privacy Policy explains how we collect, use, share, and protect your information in compliance with:

2. Information We Collect

2.1 Information You Provide

When you use TechTree, you may provide:

• Contact Information: Name, email address, phone number
• Professional Information: CV/resume, LinkedIn profile, work history, skills, qualifications, education, salary expectations, location preferences, role preferences
• Application Materials: Cover letters, portfolios, certificates, work samples
• Communication Data: Messages exchanged with employers or TechTree
• Referral Information: Social media profiles and email addresses of people you refer (with their subsequent consent when they apply)
• Feedback: Responses to job postings, platform features, and recruitment experiences

2.2 Information We Collect Automatically

• Device & Usage Data: IP address, browser type, device type, operating system, pages visited, time spent on Platform, referring URLs
• Cookies & Tracking Technologies: See Section 11 (Cookies & Tracking)
• Analytics Data: Interaction patterns, feature usage, click data

2.3 Information From Third Parties

• Public Sources: Publicly available professional profiles (LinkedIn, GitHub, etc.)
• Integrated Services: Data from services you connect (Google, LinkedIn, etc.)
• Employer Partners: Information provided by employers about recruitment processes

We do not collect, purchase, or use data from third-party data brokers.

2.4 Special Category Data

We make every reasonable effort to avoid collecting or processing special category data (e.g., race, ethnicity, religion, health, sexual orientation, disability status) as defined under GDPR Article 9. Our AI systems are designed to exclude such information from analysis. However, if such data is incidentally included in your CV or application materials, we process it only with your explicit consent and in accordance with applicable law.

3. How We Use Your Information

We process your personal data for the following purposes:

3.1 Job Matching & Recruitment Services

• Analyze your CV and profile to assess fit for job opportunities
• Match you with relevant jobs from TechTree clients
• Display aggregated job listings from external sources (you apply directly on external sites)
• Share your profile and application materials with employers whose jobs match your preferences
• Facilitate communication between you and employers
• Provide AI-driven job recommendations and career insights

3.2 Referral Requests

• Identify roles where you may know qualified candidates
• Request recommendations for specific positions
• Facilitate referrals when recommended individuals express interest and provide consent

3.3 Communication & Updates

• Send recruitment process updates from employers
• Inform you about Platform features, events, and improvements
• Respond to your inquiries and provide customer support
• Request feedback to improve our services

3.4 AI Training & Platform Improvement

• Use your feedback on job postings to train and improve our AI models
• Enhance matching algorithms and recommendation systems
• Optimize Platform performance and user experience
• Analyze aggregated usage trends (anonymized)

3.5 Security & Legal Compliance

• Detect and prevent fraud, abuse, or unauthorized access
• Ensure Platform security and operational integrity
• Comply with legal obligations and regulatory requirements
• Protect the rights, property, or safety of TechTree, users, or others

3.6 Analytics & Business Intelligence

• Understand Platform usage patterns
• Produce anonymized reports for product development
• Measure effectiveness of recruitment services

4. Legal Basis for Processing

We process your personal data based on:

• Consent: You provide explicit consent when you apply to jobs or share your information. You may withdraw consent at any time by emailing data@techtree.dev.
• Legitimate Interests: Platform security, fraud prevention, analytics, service improvement, and business operations (balanced against your rights and interests)
• Contractual Necessity: Processing necessary to provide our services to you
• Legal Obligations: Compliance with applicable laws and regulations

5. Automated Decision-Making & AI Processing

5.1 How Our AI Works

TechTree uses artificial intelligence and machine learning to:

• Analyze CVs and professional profiles to understand skills and experience
• Match candidates with relevant job opportunities
• Generate job recommendations
• Prioritize candidate-job matches for employers

5.2 Human Oversight

All AI-driven decisions are subject to human oversight. Our team reviews AI recommendations before sharing candidate profiles with employers. No candidate is automatically rejected or excluded from opportunities solely by automated processing.

5.3 Your Right to Human Review

You have the right to:

• Request additional human review of any AI-driven matching decision
• Contest any decision made about your profile
• Receive an explanation of how a decision was reached

To exercise these rights, email data@techtree.dev with details of the decision you wish to contest.

5.4 Logic & Impact

Our AI considers factors including:

• Skills and qualifications match
• Experience level and career progression
• Location and work preferences
• Industry and role compatibility

AI matching affects which job opportunities are recommended to you and how your profile is prioritized for employers. It does not automatically exclude you from opportunities.

6. How We Share Your Information

6.1 With Employers (TechTree Clients)

When you apply to a job from a TechTree client or when your profile matches an employer's requirements, we automatically share:

• Your CV and application materials
• Contact information
• Professional profile and preferences
• Communication history related to the opportunity

You can opt out of automatic profile sharing by emailing data@techtree.dev to request manual approval before each share.

6.2 With Service Providers

We share data with trusted third-party service providers who assist in operating the Platform:

All service providers are contractually bound to protect your data and use it only for specified purposes. Data may be processed outside the UK/EEA; we use Standard Contractual Clauses (SCCs) or equivalent safeguards where required.

6.3 With Business Partners & Affiliates

We may share data with trusted business partners for joint marketing, customer support, or service delivery. We do not share your data with external job boards or aggregators without your explicit consent.

6.4 For Legal Reasons

We may disclose your information when required by law or when we believe disclosure is necessary to:

• Comply with legal obligations, court orders, or government requests
• Enforce our Terms of Service
• Protect the rights, property, or safety of TechTree, users, or the public
• Detect or prevent fraud, security issues, or illegal activity

6.5 Business Transfers

If TechTree is involved in a merger, acquisition, or sale of assets, your information may be transferred to the acquiring entity. You will be notified of any such change.

6.6 We Do Not Sell Your Personal Data

TechTree does not sell or rent your personal information to third parties. Under CCPA/CPRA, we do not "sell" or "share" personal information as defined by California law.

7. Data Retention

We retain your personal data for as long as necessary to provide our services and fulfill the purposes described in this Privacy Policy.

Retention Period: Personal data is retained for up to 36 months from your last activity on the Platform (e.g., last application, last login, or last communication).

Deletion: After the retention period, or upon your request, we will delete or anonymize your personal data unless:

• Retention is required by law (e.g., tax, employment, or regulatory obligations)
• Retention is necessary for legal claims or disputes

Request Deletion: You can request early deletion by emailing data@techtree.dev. We will respond within 30 days. Note that deletion may limit our ability to provide services and historical records.

8. Your Privacy Rights

8.1 Rights Under UK/EU GDPR & Swiss FADP

• Access - Request a copy of your personal data
• Rectification - Correct inaccurate or incomplete data
• Erasure - Request deletion of your data (subject to legal obligations)
• Restriction - Limit how we process your data

• Withdraw Consent - Withdraw consent at any time (does not affect prior lawful processing)
• Lodge a Complaint - Contact your supervisory authority (UK: ICO at ico.org.uk)

8.2 Rights Under CCPA/CPRA (California Residents)

California residents have additional rights:

• Right to Know - Request disclosure of personal information collected, sources, purposes, and categories of third parties we share with
• Right to Delete - Request deletion of personal information (subject to exceptions)
• Right to Correct - Request correction of inaccurate personal information
• Right to Opt-Out - Opt out of "sale" or "sharing" of personal information for targeted advertising
• Right to Limit Sensitive Personal Information - Limit use of sensitive personal information to necessary purposes
• Non-Discrimination - Exercise privacy rights without discriminatory treatment

TechTree does not discriminate against users who exercise their privacy rights.

8.3 How to Exercise Your Rights

To exercise any privacy rights, email data@techtree.dev with:

• Your full name and email address used on the Platform
• Specific right(s) you wish to exercise
• Any relevant details or supporting information

We will verify your identity and respond within 30 days (or as required by law). For California requests, we may require additional verification for security purposes.

Authorized Agents (California): You may designate an authorized agent to submit requests on your behalf. The agent must provide written authorization and we may verify your identity directly.

9. Opt-Out Rights

9.1 Opt-Out of Targeted Advertising

To opt out of the use of your personal information for targeted advertising purposes, email data@techtree.dev with "Opt-Out of Targeted Advertising" in the subject line.

9.2 Opt-Out of Automatic Profile Sharing

By default, your profile is shared with employers whose jobs match your preferences. To require manual approval before each share, email data@techtree.dev.

9.3 Limit Use of Sensitive Personal Information (California)

If you are a California resident, you may limit our use of sensitive personal information to purposes necessary to provide our services. Email data@techtree.dev with "Limit Sensitive PI" in the subject line.

Note: Limiting or opting out may affect our ability to provide certain Platform features or match you with job opportunities.

10. Data Security

We implement industry-standard technical and organizational security measures to protect your personal data, including:

• Encryption of data in transit (TLS/SSL) and at rest
• Secure cloud infrastructure with access controls
• Regular security audits and vulnerability assessments
• Employee training on data protection
• Restricted access to personal data on a need-to-know basis

No system is 100% secure. While we take reasonable precautions, we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your login credentials (if applicable).

11. Cookies & Tracking Technologies

11.1 What Are Cookies?

Cookies are small text files stored on your device when you visit the Platform. We use cookies and similar technologies (pixels, web beacons, local storage) to enhance your experience and analyze Platform usage.

Note: Disabling cookies may affect Platform functionality and your user experience.

11.5 Do Not Track (DNT)

We currently do not respond to "Do Not Track" signals from browsers, as there is no uniform standard for DNT. We will update this policy if standards are established.

12. International Data Transfers

TechTree is based in the United Kingdom. If you access the Platform from outside the UK/EEA, your personal data may be transferred to and processed in the UK or other jurisdictions where our service providers operate.

We ensure appropriate safeguards for international transfers:

• Standard Contractual Clauses (SCCs) approved by the European Commission
• Adequacy Decisions where applicable (e.g., UK-EEA data sharing)
• Other lawful transfer mechanisms as required

By using the Platform, you consent to the transfer of your data as described in this policy.

13. Children's Privacy

TechTree is not intended for individuals under the age of 16. We do not knowingly collect personal data from children under 16. If we learn that we have collected data from a child under 16 without parental consent, we will delete it promptly.

15. Your Consent & Withdrawal

By applying to jobs on TechTree or sharing your information with our talent partners, you provide explicit consent to the collection, processing, and sharing of your personal data as described in this Privacy Policy.

You may withdraw consent at any time by emailing data@techtree.dev. Upon withdrawal:

• We will stop processing your data for purposes requiring consent
• We will delete your data unless retention is required by law or for legitimate interests (e.g., legal claims)
• You will no longer be able to use TechTree services

Withdrawal of consent does not affect the lawfulness of processing conducted prior to withdrawal.

16. Updates to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our practices, legal requirements, or Platform features.

Notification of Changes:

• Material changes will be communicated via email or prominent notice on the Platform
